Minimum notice period for operational changes

All employees covered by collective agreements at the main business location in Germany are covered by the regional collective agreement of IG BCE Bergbau, Chemie und Energie (collective wage agreement from 2017). At Bionorica SE, the sales force and non-payscale employees also benefit from some of these benefits. 

Works agreements apply to the above groups. The works council must be informed by the management about operational changes in a timely and comprehensive manner. A one-week consultation period for the works council is stipulated for new hires and resignations initiated by the employer, and three days for terminations without notice. As a rule, works agreements may be terminated by the employer as well as by the employee representatives with three months’ notice to the end of the quarter. 

Employment contract: unless otherwise stipulated in the employment contract, the company’s collective agreement as amended and the company’s works agreements apply to the employment relationship. These include regulations on working hours, holidays, incapacity for work, contributions to capital formation and annual bonuses.

If the company’s collective agreement comes to an end, the collective agreements applicable at that time continue to apply statically as amended unless they are replaced or superseded by other agreements. No further adjustment is made. Any ineffective works agreement or collective agreement provision is be replaced by the relevant statutory provision.
